The Service is offered solely as a technological tool to assist with drafting tasks. It does not constitute legal advice, legal representation, or legal services. DraftIt.in is not a law firm, and the use of the Service does not establish an attorney-client relationship.

1.3 User Responsibility for Legal Review

All Generated Content is provided for informational purposes only and may contain inaccuracies, omissions, or legal deficiencies. You are solely responsible for independently reviewing, validating, and obtaining professional legal advice before relying upon or using any Generated Content.

1.4 Professional Duty

If you are a lawyer or legal professional, you remain solely responsible for ensuring compliance with professional and ethical obligations applicable to your jurisdiction.

2. USER OBLIGATIONS

2.1 Accuracy of Inputs

You are solely responsible for the accuracy, completeness, and legal permissibility of any information, text, or instructions you submit ("User Inputs").

2.2 Prohibited Submissions

You shall not submit or disclose through the Service:

• Personal identifiable information (PII) of any individual
• Confidential or privileged information
• Proprietary business information, trade secrets, or commercially sensitive data

You acknowledge that User Inputs will be transmitted to third-party AI/LLM providers for the purpose of generating the Requested Output.

3.2 Explicit Consent

By utilizing any AI-driven function (including Generate, Modify, Compare, Analyze, Extract), you expressly consent to such transmission and processing.

3.3 Model Limitations

AI outputs may contain errors, hallucinations, or unreliable interpretations. You acknowledge and accept these limitations and agree that all Generated Content must be independently reviewed.

3.4 No Retention of Inputs by DraftIt

DraftIt does not store your clause content, context, or submitted text. (See Privacy Notice for details relating to rate-limit technical data processing.)

4. USAGE LIMITS AND FAIR USE

4.1 Rate Limiting

DraftIt.in enforces usage limits (e.g., a daily clause-generation cap per user). These limits may be adjusted at any time.

4.2 Technical Identifiers

To ensure fair use, the Service may process non-personal technical identifiers such as IP address, request count, and reset timestamps, solely for rate-limit enforcement.

4.3 Prohibited Circumvention

Any attempt to circumvent, manipulate, or obscure usage metrics constitutes a breach of these Terms and may result in immediate suspension.

5. SERVICE AVAILABILITY

5.1 No Guarantee of Uptime

The Service is provided on an "as available" basis. We do not guarantee uninterrupted availability.

5.2 Modifications and Updates

We may enhance, modify, restrict, or discontinue any part of the Service at our discretion without prior notice.

5.3 Suspension

We may suspend access (temporarily or permanently) for maintenance, misuse, legal compliance, or security reasons.

6. INTELLECTUAL PROPERTY

6.1 Ownership

All intellectual property in the website, software, algorithms, UI/UX design, templates, and branding is owned by DraftIt.in or its licensors.

6.2 License to You

You are granted a limited, non-exclusive, revocable right to access and use the Service for lawful purposes.

6.3 Generated Content

Subject to third-party model terms and your compliance with these Terms, you may use the Generated Content for lawful business or personal purposes.

6.4 Restrictions

You may not copy, rent, sell, sublicense, distribute, or create derivative works from the Service or any component thereof.

7. DISCLAIMERS

7.1 General Disclaimer

THE SERVICE AND GENERATED CONTENT ARE PROVIDED "AS IS", "AS AVAILABLE", AND WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY.

7.2 No Warranty

WE DISCLAIM ALL WARRANTIES INCLUDING, WITHOUT LIMITATION:

• Fitness for a particular purpose
• Accuracy, completeness, or legal enforceability of Generated Content
• Non-infringement
• Reliability, availability, or performance of the Service
• Error-free or uninterrupted operation

7.3 No Legal Liability for Generated Content

You acknowledge that you alone are responsible for verifying the correctness, applicability, and legal adequacy of all outputs.

8. LIMITATION OF LIABILITY

8.1 Maximum Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DRAFTIT.IN SHALL NOT BE LIABLE FOR:

• Indirect, incidental, consequential, exemplary, or punitive damages
• Loss of profits, revenue, goodwill, data, or business interruption
• Any reliance placed upon Generated Content

8.2 Aggregate Cap

Our total aggregate liability in any 12-month period shall not exceed the amount you paid for access to the Service during such period. For free users, our liability shall be zero.

8.3 Risk Allocation

You acknowledge that these limitations are fundamental elements of the basis of the bargain between you and DraftIt.in.

9. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless DraftIt.in, its operators, affiliates, employees, and service providers against all claims, actions, losses, liabilities, damages, and expenses (including legal fees) arising out of:

• Your use of the Service or Generated Content
• Your failure to conduct appropriate legal review
• Your violation of these Terms
• Your violation of applicable laws
• Your submission of Prohibited Content

10. TERMINATION

10.1 Right to Terminate

We may suspend or terminate your access to the Service at any time, with or without notice, for any reason, including breach of these Terms, misuse, abuse, or security concerns.

10.2 Effect of Termination

Upon termination, your right to access and use the Service shall immediately cease. Sections relating to intellectual property, disclaimers, limitations of liability, indemnification, governing law, and dispute resolution will survive termination.

11. GOVERNING LAW AND JURISDICTION

These Terms shall be governed exclusively by the laws of India.

Any disputes arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts located in Mumbai, India.

This clause is intended to be enforceable globally under standard conflict-of-laws principles.
